Hyowook Chiang, Ph.D., Senior Managing Director at Welch Consulting, will be co-presenting, “Under the Hood: Considerations in Wage and Hour Audits” on February 17 at the 2022 Federal Labor Standards Legislation Committee Midwinter Meeting in Koloa, Hawaii.

Dr. Chiang is an expert on wage and hour claims and class actions. He has assisted with a wide range of FLSA and state-specific wage/hour matters such as regular rate of pay, overtime pay, meal/rest break violations, rounding, misclassification, off-the-clock work, donning and doffing, and alternative work arrangements claims. He has provided declarations and deposition testimony, and supported clients in mediation and trial.

Wage and Hour audits can vary in size, scope, and origin—from internal audits by employers for purposes of identifying and addressing potential compliance issues, to audits by the Department of Labor in response to employee complaints. Panelists will address a panoply of considerations for when audits arise. With respect to DOL audits, how can an employer prepare for such an audit or negotiate with a DOL investigator over the scope or outcome of the audit? For internal audits, what are some best practices employers should follow? And from the plaintiffs’ perspective, how can you potentially use an audit uncovered during discovery to your advantage?
